Carnival Curfew Regulations and Exemptions

These are the official restrictive measures for Carnival week.

“- To determine the prohibition of circulation on public roads, in the entire territory of the Autonomous Region of Madeira, in the period between the 15th and the 19th of February 2021, between 6:00 pm and 5:00 am of the following day, including the following exceptions:

a) Professional travel, as attested by a declaration;

b) Health professionals and other workers from health and social support institutions;

c) Civil protection agents, military personnel, inspectors from the Regional Economic Activities Authority (ARAE) and security forces;

d) Ministers of worship;

e) Staff from diplomatic and consular missions;

f) Travel for health reasons;

g) Emergency reception of victims of domestic violence or trafficking in human beings;

h) Assistance to vulnerable people or people with disabilities;

i) Fulfill parental responsibilities;

j) Urgent medical-veterinary assistance;

k) Exercise of freedom of the press;

l) Return to the home within the scope of admitted travel;

m) Travel to the airport to board and disembark passengers;

n) Travel by public transport, taxis and TVDE, within the scope of the exceptions allowed in this paragraph;

o) Bakery professionals, to perform night work;

p) Other reasons of force majeure, provided that it can be shown that they cannot be postponed or justified.

The same resolution determines that in the period between the 15th and the 19th of February 2021, activities of a commercial, industrial and service nature in RAM close at 5 pm, with the exception of the following establishments:

a) Workshop pharmacies;

b) Clinics, medical and veterinary offices, medical services or other health and social support services;

c) Oxygen and medical gas services at home;

d) Fuel filling stations (only for filling vehicles);

e) Bakery sector;

f) Port activity for loading and unloading goods and their distribution;

g) Commercial establishments located inside the airports of Madeira and Porto Santo, after checking the security of passengers;

h) Companies that operate in the service sector, which have been contracted by any of the sectors of activity identified in the previous paragraphs, by entities linked to the provision of essential services, within the meaning of the provisions of article 10 of Decree-Law no. 10-A / 2020, of 13 March, in its current wording, or even by the public entities referred to in number 15 of the Governing Council Resolution no. 19/2021, published in JORAM, I Series, no. 7, of January 12, 2021, provided they are duly accredited by the entity contracting the service to be provided;

i) Tourist enterprises and local accommodation establishments.

In the same period, restaurants / bars and the like also close at 5 pm, however, they can continue working from 5 pm until 10 pm, exclusively for making meals for home delivery, under the terms of number 6 of this Resolution.

The same happens – closing at 5 pm – with all gambling establishments, casinos, bingo or similar.

The restaurants / bars and similar located inside the airports of Madeira and Porto Santo, in the reserved area after the passenger security control, and the restaurants of the tourist undertakings and local accommodation establishments, for the purpose of providing the meal service exclusively to their guests, they maintain their normal opening hours.

In this resolution, it is also stipulated that professionals associated with the delivery of meals at home may circulate after the curfew, until 10 pm, with proper identification and accreditation.

It should be added that all establishments and activities must comply with the sanitary and access control rules in force.

It should also be noted that all passengers disembarking at the Airport and Porto do Porto Santo must have a PCR test for screening for SARS-CoV-2 infection with a negative result, performed within a maximum period of 72 hours prior to disembarkation; or alternatively, they must perform, with the collection of biological samples on arrival, a PCR test for infection by SARS-CoV-2, to be promoted by the health authority, and must remain in prophylactic isolation, in the respective home or in the hotel where they are located. until the negative test result is obtained.

At the same time, all residents of Porto Santo who travel outside the island of Porto Santo for a period of up to 7 days, continue to have to perform a PCR test to detect SARS-CoV-2 infection on the 5th day after disembarkation , guaranteeing its prophylactic isolation from the return until obtaining the negative result of the said test.

In the resolution, it remains determined that emigrants, migrants, students returning from vacation and all those who will cohabit with residents in Porto Santo, must submit a negative PCR test for SARS-CoV-2 infection carried out in the past 72 h, and repeat it between the 5th and 7th day after the date of the last test, ensuring its prophylactic isolation.

The resolution maintains that all people are obliged to comply with the guidelines issued by the competent health authorities and the duty to comply and collaborate with the measures provided for in this Resolution.

It should be stressed that disobedience to the order or legitimate order issued by the health authority established under the scope of this Resolution incurs the respective offenders in the practice of the crime of disobedience provided for and punished in the legislation in force.

The implementation of the provisions of the Resolution approved today is coordinated and monitored by the competent Health and Civil Protection Authorities, which are now authorized to request the collaboration of the security forces, as well as the use of human and material resources from the administration. regional public sector.

The measures provided for in the Resolution of the Governing Council No. 19/2021, published in JORAM, I Series, No. 7, of January 12, 2021, as amended through Resolution of the Government Council No. 21 / 2021, published in JORAM, I Series, no. 10, 2nd Supplement, of January 15, 2021, extended through Resolution of the Governing Council no. 69/2021, published in JORAM, I Series, no. 19, Supplement, of January 29, 2021, which conflict with the provisions of this Resolution, in the period between the 15th and the 19th of February 2021.

Paragraphs 2 and 18 of the Resolution of the Government Council no. 1/2021, published in JORAM, I Series, no. 1, 2nd Supplement, of January 4, 2021, are revoked.

This Resolution takes effect from 0:00 hours on February 15, 2021 and is effective until 23:59 hours on February 19, 2021, with the exception of the provisions of numbers 8, 9 and 10 of this Resolution, which runs until March 15, 2021.

– Exempt taxi industrialists from the fees to be applied to metrological control of taximeters, taking into account the difficulties that the sector is experiencing, following the pandemic caused by COVID-19.

The exemption will be in effect until December 31, 2021.

– Exempt, during the months of February to April 2021, the users of the Center for Supply of Agricultural Products of Funchal (CAPA) who require them, from the payment of the refrigeration conservation fee provided by that establishment.

– Exempt wholesalers who have a protocol for allocating the right to operate one or more fixed points of sale at the Funchal Agricultural Products Supply Center (CAPA), or another title that confers that right, from the payment of applicable rents from February to April 2021.

– Approve legislative changes that will allow the process of unfreezing the careers of senior technicians in the areas of diagnosis and therapy at SESARAM to begin.

– Authorize the anticipation of part of the payment of compensatory allowances to public passenger transport companies in the Region, to which they are entitled.

The measure does not entail an increase in expenditure for the Region’s budget and aims to respond to the treasury difficulties of the companies in question.”
