Court Overturns Unlawful Dismissal

The Court of Appeal annulled the decision to dismiss a security guard who worked at Madeira Airport – Cristiano Ronaldo, after he found two gold rings on the ground, revealed the Jornal de Notícias (JN), yesterday in its online edition.

The company for which the security guard worked initiated a disciplinary procedure that culminated in dismissal for cause, alleging violation of internal procedures. At issue was the fact that the worker did not deliver the parts to the airport’s Public Security Police (PSP), as determined by airport security regulations.

After finding the rings at the airport facilities in Santa Cruz, the security guard chose to try to identify the owners on his own. To do this, he published information on social networks and even contacted a local priest in an attempt to locate the owners of the objects. The employer considered that this action constituted a serious violation of internal rules, deciding to proceed with the dismissal.

The case was initially considered by the Funchal Court, which considered the security guard’s behaviour illegitimate, understanding that he did not comply with his professional duties and validating the dismissal for just cause. Dissatisfied, the worker appealed to the Lisbon Court of Appeal. The judges overturned the decision, concluding that he was unlawfully dismissed.

Even so, the court recognised that the security guard did not fully comply with the procedures defined by the company and airport regulations. concluding, the judge stressed that the worker’s intention to return the rings to their owners was demonstrated, despite having resorted to unauthorised means in the context of airport security.
