Madeira Remains in a State of Contingency Until 28th of February

The Regional Secretary for Health and Civil Protection, Pedro Ramos, announced earlier this afternoon the new pandemic containment measures that came into force at 00:01 this morning. 

The rules have already been published on JORAM and remain in effect until the 28th of February. 

Thus, it is determined that each traveller who disembarks at airports, ports and marinas in the Autonomous Region of Madeira, from any territory outside the RAM, is required to present, as an alternative, the following documents:

a) Digital Covid Certificate from the European Union, complete with the three doses of the vaccine against covid-19, or document certifying that the bearer has been vaccinated against covid-19, according to the recommended plan and respecting the system activation period immunity provided for in the Summary of Product Characteristics (SPC);

b) Incomplete European Union Covid Digital Certificate with two doses of the Covid-19 vaccine, or a document certifying that the bearer has been vaccinated against Covid-19, according to the recommended plan and respecting the system activation period provided for in the Summary of Product Characteristics (SPC), or a medical document certifying that the carrier has recovered from SARS-CoV-2 infection, issued within the last 180 days;

c) Incomplete European Union Covid Digital Certificate with a dose of the Covid-19 vaccine, or a document certifying that the bearer has been vaccinated against Covid-19, according to the recommended plan and respecting the system activation period provided for in the Summary of Product Characteristics (SPC), or a medical document certifying that the carrier has recovered from SARS-CoV-2 infection, issued within the last 180 days;

d) Children up to 11 years of age are excluded from the procedures established in the previous numbers.

It is also recommended that all travellers who disembark in the Madeira archipelago and those travelling between islands (Madeira and Porto Santo), either by air or sea, register with Madeira Safe, through the electronic address www.madeirasafe .with.

Determines the mandatory use of a mask by people aged from 6 years old for access, circulation or stay in public spaces and roads whenever the physical distance recommended by the health authorities proves to be impracticable, under the terms of Regional Regulatory Decree n. 16-A/2021/M, of 21 December, the obligation being waived in the following situations: a) Upon presentation of

: i) Medical certificate of multipurpose incapacity or medical declaration, in the case of people with cognitive or developmental disabilities or with mental disorders; 4 – S Number 16 January 31, 2022

ii) Medical statement attesting that the person’s clinical condition is not consistent with the use of a mask;

b) When the use of a mask is incompatible with the nature of the activities that people are carrying out;

c) In relation to people who form part of the same household, when they are not in the proximity of third parties.

Recommends to the local population and visitors, and to the owners and holders of commercial and industrial establishments, full compliance with health rules, both in open spaces and in closed spaces, namely, the social distance of 1.5 meters, hand hygiene and respiratory etiquette.

Recommends to the general population to be vaccinated against covid-19, to start the vaccination schedule or continue their vaccination schedule, from the age of 5, in accordance with international recommendations:

a) The 4th dose of the vaccine will be applied to all citizens over 16 years of age who are immunocompromised patients, cancer patients, dialysis patients or transplant patients;

b) Reinforcement of the vaccination of citizens from the age of 12, with the aim of contributing to the protection of the covid-19 disease in a greater percentage of the population.

Determines mandatory confinement during the five-day period at home, in the following situations:

a) Patients with covid-19 and those infected with SARS-CoV-2;

b) The citizens referred to in the previous paragraph return to the community on the 6th day, if they do not show symptoms, without the need to carry out a TRAg test to screen for SARS-CoV-2 infection.

It determines with respect to people who have had direct contact with positive cases, the following:

a) Adults with a complete vaccination schedule (3 doses), do not isolate or perform a TRAg screening test for SARS-CoV-2 infection;

b) Adults with an incomplete vaccination schedule, do not isolate but perform a TRAg screening test for SARS-CoV-2 infection on the 5th day, free of charge in the participating entities;

c) In the education, health, social and ERPIS sectors, in case of complete vaccination with a booster dose, it is not necessary to isolate, whether in the case of professionals, residents or visitors;

d) Unvaccinated adults do not perform isolation, but perform a TRAg test to screen for SARS-CoV-2 infection on the 5th day, free of charge at participating entities.

Determines with regard to children in a school context and at all levels of education who test positive for SARSCoV-2, they are in mandatory confinement for a minimum period of five days, if they do not show symptoms, they return to school activity at the end of the five days, complying with the regulations in force without the need to carry out a screening test for infection by SARS-CoV-2.

It recommends the use of the app, s-alerta.pt/cidadão, by the population, so that their self-management of care continues to contribute to the monitoring of the pandemic in RAM, in collaboration with the health authorities.

Determines the following with respect to population testing0

: a) Massive weekly and free testing of the general population is no longer mandatory;

b) Citizens who present with a body temperature equal to or above 38°C are entitled to carry out, free of charge, the TRAg test for screening for infection by SARS-CoV-2, to be carried out in entities adhering to the protocol with the Regional Government ( ANF ​​and ACIF), regardless of their vaccination status.

Determines the obligation of citizens who wish to access or attend any activity in the community, namely restaurants, bars, clubs, gyms, sports activities and other cultural, social, recreational and similar activities, to have a complete vaccination schedule and a booster dose with fourteen days of evolution. or the presentation of a Recovered Certificate.

a) In the cases referred to in the previous number in which the citizen does not have the complete vaccination schedule, he will have to present a TRAg test for screening for infection by SARS-CoV-2, to be carried out weekly at his own expense, in the entities adhering to the protocol with the Regional Government (ANF and ACIF).

Failure to comply with the obligation established in number 4 of this Resolution constitutes an administrative offense in accordance with the provisions of article 3 of Decree-Law no. the sanctioning regime applicable to non-compliance with the duties established by decree regulating the declaration of the state of emergency and the duties established by the declaration of the alert, contingency or calamity situation.

Disobedience to a legitimate order or warrant issued by the health authority established within the scope of this Resolution causes the respective offenders to commit the crime of disobedience provided for and punished under the terms of article 348 of the Penal Code, pursuant to the stipulations of article 16. 82/2009, of 2 April, amended and republished by Decree-Law no. 135/2013, of 4 October, and article 11 by virtue of paragraph 4 of article 6 of Law no. 27/2006, of 3 July, amended and republished by Law no. 80/2015, of 3 August, which approves the Civil Protection Basic Law.

It determines that the execution of the provisions of this Resolution is coordinated and monitored by the competent Health and Civil Protection Authorities, which are, from now on, authorized to request the collaboration of the security forces, as well as the use of human and material resources of the regional public administration.

The regime established in this Resolution is subject to constant evaluation by the competent authorities, and may be subject to revision, should the circumstances underlying its determination change.

All provisions contained in the Resolutions of the Council of the Regional Government that contradict the provisions of this Resolution are hereby revoked, with the exception of the provisions temporarily maintained in force until 11:59 pm on February 6, 2022, by the final part of the following number.

This Resolution takes effect at 12:00 am on February 1, 2022 and remains in force until 11:59 pm on February 28, 2022, with the exception of number 2, which enters into force at 12:00 am on February 7 1208/2021, published in JORAM, series I, number 210, 2nd supplement of November 19, 2022, kept in force by virtue of the number 1 of Resolution no. 6/2022, published in JORAM, series I, number 6, 2nd supplement, of January 14, 2022.
