Can TVDE Law be Suspended?

Francisco Gomes, re-elected deputy for Chega to the Assembly of the Republic, is studying the possibility of requesting the temporary suspension of the application of Law No. 45/2018, which regulates the activity of Individual and Remunerated Passenger Transport in Uncharacterised Vehicles from Electronic Platform (TVDE), in the Region.

His intention is to justify four reasons for the suspension.

  1. From the outset, he states that there is no regional diploma that ensures the adaptation of the national law to the specific reality of the Region. In addition, it states that there may be a violation of the principle of fair competition, since the application of Law 45/2018 is, in its view, promoting inequalities between different economic sectors, namely between taxi operators and TVDE drivers.
  2. Francisco Gomes also warns of a possible breach of European law, which allows the authorities to intervene in cases of imbalances in local public transport. In the end, issues of public interest, administrative precaution, and the risk of legal litigation by taxi operators require, in the opinion of the deputy, that the application of the national law to the regional reality be reassessed.
  3. The abrupt entry of TVDE vehicles in Madeira, combined with the growth of the business of buying and selling licenses, is creating an unsustainable situation.
  4. The excess of vehicles is already contributing to the chaotic traffic that is felt in various parts of the Region, at certain times of the day. We must act!”

The Chega parliamentarian considers that Madeira, through the Assembly of the Republic, should consider formally requesting the suspension of the application of Law No. 45/2018 to the Region and request its review of constitutionality. For the deputy, the minimum required is a serious analysis of the impacts of national legislation on the island territory.

Francisco Gomes assures that the party is not against TVDE. “We are against chaos, inequality, and illegality. The Region needs fair and balanced rules, adapted to our reality, and that they truly serve the public interest,” he concludes.
