There have been Criminal Criminal Investigation requests submitted so far to the Criminal Criminal Investigation Court of Funchal against mandatory confinement.
The requests are considered useless as the people requesting habeas corpus have had negative Covid-19 results.
Urged to comment on the situation, lawyer Ricardo Vieira recalled that the restrictive measures of citizens’ rights, freedoms and guarantees “obey several criteria, especially the principle of proportionality,”so they should be as less burdensome as possible.
However, the lawyer considers that the mandatory confinement should have ended when the state of emergency ended. “The state of emergency is over and there is no constitutionally established tool that allows people to be confined for 14 days in a hotel. The alternative is for people arriving at Madeira Airport to be tested right away. Once it is proven that they are not carriers of the virus, then they can circulate freely. If the test is positive, appropriate measures should be taken for those who are infected, that is, they can be confined.”
